UAE Court Issues Landmark Ruling on Sports Arbitration

The UAE Sports Arbitration Centre has announced the issuance of a ruling by the General Authority of the Dubai Court of Cassation, stating that it is impermissible to file a lawsuit for annulment against the Centre's rulings for all disputes brought before its first and appellate chambers. This judicial precedent enhances the status of sports arbitration in the United Arab Emirates. The ruling from the Dubai Court of Cassation is based on the principle that the UAE Sports Arbitration Centre's rulings are final, binding, and not subject to appeal, possess executive force, and it is prohibited to initiate a lawsuit to annul the Centre's arbitration award before the courts or to object to the arbitration award except before the enforcement judge through a substantive enforcement lawsuit. Jamal Hamed Al-Murri, Chairman of the UAE Sports Arbitration Centre, stated that this ruling represents a significant qualitative leap and a historical step in the journey of sports arbitration at the state level, solidifying the Centre's status and its exclusive jurisdiction in resolving sports disputes. He commended the ruling of the Dubai Court of Cassation, affirming that the UAE will remain a beacon of swift justice and a model to be emulated in all legal and judicial fields, achieving equality for all and ensuring that every right is given to its rightful holder within the sports ecosystem. He mentioned that this ruling culminates the precise legislative and regulatory efforts that have established the principle of independence of the Emirati sports arbitration and confirmed the soundness of the legislation and procedural rules governing the work of the UAE Sports Arbitration Centre.
